GENERAL TERMS AND CONDITIONS OF SALE
The products made available on this site are for strictly personal use. In the event of an order for products intended for resale, SANALYSLAB reserves the right to refuse the order. We will soon be opening a "distributors" area on this website.
Orders are prepared by our staff in collaboration with our UK-based fulfilment centre. Each product is shipped with a clear plastic seal around the cap. This is a security feature that ensures the bottle is not tampered with. We reserve the right to offer you SANALYSLAB goodies.
If the seal is not present on the bottle, you should not accept your package. Your order will then be returned and a request for compensation will be made by us to the carrier. You will then be reimbursed after receipt of the package.
1. Purpose of the General Terms and Conditions of Sale
1.1 To what do these terms and conditions apply?
The present conditions of sale apply, without restriction or reserve, to all sales concluded between, on the one hand, the company SanalysLab, a simplified joint stock company, registered in the Lyon Trade and Companies Register, under the number 884 514 688, whose head office is 335 rue Ferdinand Perrier, 69330 Saint-Priest, whose intra-community VAT number is FR48884514688, whose trade name is SanalysLab (hereinafter referred to as "SanalysLab"), and on the other hand, any non-professional buyer (hereinafter referred to as the "client" or "clients") wishing to acquire the products offered for sale by SanalysLab (hereinafter referred to as the "products") via the website (hereinafter referred to as the "Website"). They specify in particular the conditions of order, payment, delivery and management of possible returns of the Products ordered by the clients.
1.2 What products do we offer?
The products offered for sale on the website are food supplements, plant extracts, probiotics, cosmetics and care products. The main characteristics of the products and in particular the specifications, illustrations and indications of dimensions or capacity of the products are presented on the website. The customer is obliged to take note of these before placing an order. The choice and purchase of a product is the sole responsibility of the customer. The colour and graphic elements of the bottles may be modified. These modifications do not in any way lead to a change in the formulation of our products, but may occur for reasons of brand image or stock (for example, a certain type of bottle being out of stock).
The customer is obliged to refer to the description of each product in order to know its essential properties and particularities.

1.4. What will happen if you accept these terms and conditions?
Validation of the order by the customer implies acceptance without restriction or reservation by the customer of these conditions of sale. The client acknowledges having the required capacity to contract and acquire the products offered on the website. These conditions of sale will prevail over any other general or particular conditions not expressly approved by SanalysLab. These general conditions of sale are accessible at any time on the website. The client declares that he/she has read the present general sales conditions and has accepted them by ticking the box provided for this purpose before the implementation of the online ordering procedure as well as the general conditions of use of the website.
1.5. Can these GTC be modified and if so, under what conditions?
SanalysLab reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date the client places the order. Unless proven otherwise, the data recorded in the computer system of SanalysLab constitute the proof of all transactions concluded with the client. The general conditions of sale are concluded for the time necessary to supply the products. In accordance with the French Data Protection Act of January 6, 1978 and the RGPD Regulation, the client has the right to access, rectify and oppose all his personal data at any time by writing, by mail and proving his identity, to the address mentioned above.
2. Controls
2.1. How do I place an order with SANALYSLAB?
The customer may place an order via the Internet on the Website. The Customer who wishes to place an order on the Website must order according to the following procedures:
- create a "customer account" in which he/she will indicate all the requested details.
- create an online basket by selecting all the Products chosen.
- accept these general terms and conditions of sale, validate his/her order after having checked it.
- make the payment under the conditions provided.
Any order implies unreserved acceptance of these general terms and conditions of sale. Any order implies acceptance of the prices and description of the products available for sale.
The contractual information is presented in French and is confirmed at the latest when the Customer validates the order.
From the moment the Customer has validated his order, he is deemed to have accepted with full knowledge of the facts and without reservation the present general conditions of sale, the prices, volumes and quantities of products offered for sale and ordered.
2.2. When will the customer's order be considered final?
The sale shall not be considered final until SANALYSLAB has sent the Client confirmation of acceptance of the order (with a summary) by e-mail and SANALYSLAB has received payment in full. It is the Client's responsibility to check the accuracy of the order and to report any errors immediately. Any order placed on the Internet Site constitutes the formation of a contract concluded at a distance between the Client and SANALYSLAB.
2.3 What happens if you order a product that is unavailable or out of stock?
N.B. Normally, if a product is unavailable or out of stock, the website will not allow customers to place an order.
SANALYSLAB's product offers are valid within the limits of available stocks. When a Product ordered is unavailable and/or out of stock, the Client is informed of this and is also informed of the period of availability of the out-of-stock Product by e-mail or, in the case of an order for several Products, on the invoice for the Products sent. SANALYSLAB may not be held liable for the unavailability of a Product. In the event of unavailability and/or shortage of stock of a Product(s), the Client may request, at his choice:
- A full refund of the unavailable or out-of-stock Product,
- Receive a credit note for the amount of the price of the unavailable or out-of-stock Product to be used for a subsequent order.
Only the definitive breakage of a Product by SANALYSLAB's suppliers shall lead to its removal from our sales offer. SANALYSLAB will then remove this Product from the Internet Site as soon as possible.
Unless there is proof to the contrary, the data recorded by SANALYSLAB constitutes proof of all transactions between SANALYSLAB and its clients.
3. Offers and prices
3.1 How are changes to our prices handled?
SANALYSLAB reserves the right to modify its prices at any time but undertakes to apply the prices in force at the time of the order, subject to availability on that date. Offers and Products are supplied at the prices in force on the Website, at the time the order is placed.
3.2 How are the prices of our products indicated? What about shipping costs and promotional offers?
The prices of the products are indicated in euros, all taxes included, and do not take into account the delivery costs, invoiced in supplement, and indicated before the validation of the order, of packing and treatment of the order.
Promotional offers are valid during the period of validity they mention and as long as they are displayed on the Website, as well as within the limits of available stocks. Orders can only be accepted if the prices mentioned are in line with those of the current offer.
The price is payable in cash, in full and in a single instalment on the day the order is placed by the Customer, by secure payment. At no time may the sums paid be considered as a deposit or advance payment. No cash on delivery will be accepted for any reason whatsoever. If one or more taxes or contributions, in particular environmental taxes, were to be created or modified, either upwards or downwards, this change could be reflected in the selling price of the products.
All orders are invoiced in Euros and payable in Euros.
SANALYSLAB reserves the right, in the event of non-compliance with the terms of payment, to suspend or cancel the delivery of orders in progress made by the Client.
4. Delivery
N.B. Delivery is the transfer to the Customer of physical possession or control of the Product.
4.1. How are delivery costs calculated?
For each order, a fixed contribution to the costs of provision is requested, which includes postage, packaging and processing of the order. The fixed contribution is indexed to the delivery method chosen by the Customer when placing the order. Delivery costs are free of charge for orders over €55.
The contribution to postage costs includes VAT.
In order to reduce transport costs, all small or medium-sized Products are sent by the Colissimo Suivi service of La Poste or a third-party delivery service, which undertakes to deliver within 8 working days throughout France and offers the Customer the possibility of collecting the products ordered at the post office near the delivery address in the event of absence from the initial delivery location when the postman arrives. If the Customer is absent on the day of delivery, the postman will leave a notice in his letterbox, which will allow him to collect his parcel at the post office during opening hours, within a period of fifteen days. The Customer is able to track his order thanks to the tracking number that is sent to him by email on the day the order is shipped.
For reasons of availability, an order may be delivered to the Customer in several instalments. In this case, the Customer only pays for one delivery.
4.2. What are the delivery times?
SANALYSLAB undertakes to do its best to deliver the Products ordered by the Client as soon as possible. For more information, we invite you to read our delivery conditions. However, if the Products ordered have not been delivered within thirty (30) days of the order being placed, the Client must inform SANALYSLAB as soon as possible, by telephone or email.
SANALYSLAB will contact the carrier to carry out an investigation, which may last up to twenty-one (21) days. If the Products are found, they will be sent back to the Client's home. If the Products are not found at the end of the investigation, the Products will be deemed lost and SANALYSLAB will then be able to send back to the Client replacement Products, at no extra cost to the Client. If the Products ordered were no longer available, SANALYSLAB will refund the amount of the Products deemed lost.
In any case, if the Products have not been delivered within twenty (20) days after the indicative delivery date, for any other reason than force majeure or the fact of the Customer, the sale may be cancelled at the written request of the Customer under the conditions provided for in articles L. 216-2 to L. 216-4 of the Consumer Code. The sums paid by the Customer will then be returned to him at the latest in the fourteen days which follow the date of denunciation of the contract, with the exclusion of any compensation or deduction.
4.3. What happens if you enter the wrong delivery address?
The Products are delivered to the address indicated by the Customer when placing the order. The Client must ensure that this address is correct. Any parcel returned to SANALYSLAB because of an incorrect or incomplete delivery address will be re-sent at the Client's expense and SANALYSLAB shall not be held responsible for the impossibility of delivering the order. If the Client wishes to be delivered to two separate delivery addresses, he/she must place two separate orders, with the related delivery charges.
4.4. What should you do when you receive the order?
Upon receipt of the order, the Customer is required to check the condition of the Products delivered. In the event of apparent defects, the Customer has the right to return the Products in accordance with the conditions set out in these general conditions. Any anomaly concerning the delivery (i.e.; missing or damaged Products, damaged packages) must imperatively be indicated, in the first instance, on the delivery slip and in the form of handwritten reserves accompanied by the customer's signature to the carrier. Secondly, any anomaly must be notified as soon as possible after receipt of the Products to SANALYSLAB:

SANALYSLAB reserves the right to ask the Client to return the damaged Product(s).
4.5 I have received a damaged package. What should I do?
If the Client notes at the time of delivery of his parcel to be handed over against a signature that the latter is damaged, he may, at his discretion, refuse the parcel which will then be returned directly to SANALYSLAB or accept the parcel while reporting the deterioration of its packaging.
If the Customer notices that the packaging of his parcel to be delivered to the letterbox is damaged, he may, provided that the parcel has not been opened, refuse the parcel by returning it to the post office, at the latest on the working day following its delivery.
4.6. How are NPAI returns handled?
Returns with the reason "NPAI" correspond to packages returned by the service provider responsible for delivery with the mention: "Does not live at the address indicated". After reception and acceptance of the returned parcel by SANALYSLAB's services, a credit note for the total amount of the order, minus shipping costs, will be credited to the Client's customer account within forty-eight (48) hours following receipt of the parcel by SANALYSLAB. The Customer may then place the order again, ensuring that the delivery address provided is correct.
4.7. How are returns handled under the reason "unclaimed"?
Returns on the grounds of "unclaimed" correspond to parcels that have not been claimed by Clients at the post office or at the retailer chosen by the Client at the time of ordering within fifteen (15) days of the notice of passage. After reception and acceptance of the returned parcel by SANALYSLAB, a credit note for the total amount of the order, minus shipping costs, will be credited to the Client's customer account within forty-eight (48) hours following receipt of the parcel by SANALYSLAB. The Customer may then place the order again.
5. Right of withdrawal
5.1. What is the withdrawal period?
In application of the provisions of article L. 221-19 of the Consumer Code, the Client has a period of fourteen (14) days from receipt of the order to exercise his/her right of withdrawal from SANALYSLAB, without having to justify his/her reasons or pay any penalty, for the purpose of reimbursement, provided that the Products are returned in their original packaging, complete and in perfect condition, allowing them to be marketed again.
5.2. How do I exercise my right of withdrawal?
Products that are damaged, already opened, soiled or incomplete shall not be taken back. The Products must be returned within fourteen (14) days following the notification to SANALYSLAB of the Client's decision to withdraw. This period shall begin at the beginning of the first hour of the first day and end at the end of the last hour of the last day of the period. If this period expires on a Saturday, Sunday or public holiday, it shall be extended to the next working day.

It is advisable to return the package by tracked mail, in the event that it is lost in the mail, as SANALYSLAB cannot be held responsible in this respect.
6. Reimbursement
6.1. How and in which cases will you proceed to reimbursement?
In the event of non-receipt of the order within the aforementioned delivery deadlines, for any reason other than force majeure or the fault of the Customer, the sale may be cancelled at the written request of the Customer, under the conditions provided for in Articles L. 216-2 of the Consumer Code. The sums paid by the Customer will then be returned to him at the latest within fourteen (14) days following the date of cancellation of the contract by the Customer, to the exclusion of any compensation or deduction.
If the Product ordered is unavailable, the Customer who has opted for a refund will be reimbursed the sums paid within fourteen (14) days of their payment at the latest.
The Client will be reimbursed within fourteen (14) days following receipt of the Products by SANALYSLAB.
The refund will be made according to the method of payment used by the Customer when ordering.
SANALYSLAB reserves the right to cancel and refund all orders placed by a professional.
6.2. 90-Day Money-Back Guarantee Terms and Conditions - SanalysLab
Product Eligibility: This warranty applies to all products purchased from sanalyslab.com. Only used products are eligible for reimbursement.
Period of Validity: Refund request must be made within 90 days of purchase date.
Return Process: To return a product, send it to the following address: 335 rue Ferdinand Perrier, 69800 Saint Priest, France. You must provide a tracking number by email as proof of shipment.
Condition of returned products: Only used products are covered by the warranty. Unopened products are not eligible for reimbursement, except under the 14-day right of withdrawal in accordance with European legislation. We consider that a minimum of 90 days is necessary to observe the effects of our products. Refunds are therefore limited to opened products. In case of purchase of a pack of several products, the refund will correspond to the quantity used. Exceptions for abuse of warranty may apply.
Return and handling charges: Return shipping costs are at the customer's expense. A handling fee of 10€ will be deducted from the refund amount.
Method of refund: Refunds will be made to the same method of payment used at the time of purchase.

7. Terms of payment
N.B. This is an order with a payment obligation, which means that the placing of the order implies payment by the Customer.
7.1. What are the payment terms?
To pay for his order, the Customer has the payment method made available to him by SANALYSLAB and listed on the Website, namely the Stripe service.
The Client guarantees SANALYSLAB that he/she has the necessary authorisations to use the method of payment chosen by him/her, when validating the order form. SANALYSLAB reserves the right to suspend all order processing and delivery in the event of refusal to authorise payment by bank card by officially accredited organisations or in the event of non-payment.
SANALYSLAB does not store any personal or financial information in its database when processing the Client's payment.
7.2. Payment by credit card
Payment by credit card is made directly online via a secure transaction with the Stripe system. The payment data is exchanged in encrypted mode using the SSL 128-bit protocol (Secure Socket Layer). When the Customer places an order on the Website, the credit card is debited immediately in the following manner: the Customer indicates in the area provided the number of his or her credit card, without any space between the digits, its date of validity, and the last three digits of the pictogram on the back of the card. The credit card is generally debited when the order is shipped.
8. Transfer of ownership - Transfer of risk
The transfer of ownership of SANALYSLAB's Products to the Client shall only take place after full payment of the price by the Client, regardless of the date of delivery of said Products. Whatever the date of transfer of ownership of the Products, the transfer of the risks of loss and deterioration relating thereto shall only be realised at the moment when the Client takes physical possession of the Products. The Products therefore travel at SANALYSLAB's risk.
9. Liability
9.1. What legal guarantees apply?
The Products sold on the Internet Site comply with the regulations in force in France. The Products supplied by SANALYSLAB are covered by law and without additional payment, independently of the right of withdrawal:
- by the legal guarantee of conformity provided for in articles L. 217-4 et seq. of the French Consumer Code, for Products that appear to be defective, damaged or not corresponding to the order,
- by the legal guarantee against hidden defects provided for in articles 1641 et seq. of the French Civil Code, arising from a defect in material, design or manufacture affecting the Products delivered and making them unsuitable for use
9.2 What are SANALYSLAB's obligations?
- According to Article L. 217-4 of the French Consumer Code, "The seller delivers goods in conformity with the contract and is liable for any defects in conformity existing at the time of delivery. He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility.
- According to Article L. 217-5 of the Consumer Code "The goods are in conformity with the contract:
1° If it is fit for the purpose usually expected of similar goods and, where applicable:if it corresponds to the description given by the seller and has the qualities that the seller has presented to the buyer in the form of a sample or model;if it has the qualities that a buyer may legitimately expect, having regard to the public statements made by the seller, the producer or his representative, particularly in advertising or labelling ;
2° or if it has the characteristics defined by mutual agreement between the parties or is fit for any special purpose sought by the buyer, brought to the attention of the seller and accepted by the latter.
- According to Article L. 217-12 of the Consumer Code "The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.
- According to Article 1641 of the Civil Code, "The seller is bound by the warranty for hidden defects in the thing sold which render it unfit for the purpose for which it was intended, or which so diminish that purpose that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them.
- According to Article 1648 of the Civil Code "The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
In order to assert his rights, the Client must inform SANALYSLAB, in writing, of the non-conformity of the Products within a maximum period of two (2) years from the delivery of the Products or the existence of hidden defects within a maximum period of two (2) years from their discovery.
The Customer may choose between repairing or replacing the goods, subject to the cost conditions set out in Article L. 217-9 of the French Consumer Code.
Shipping costs will be reimbursed on the basis of the invoiced rate and return costs will be reimbursed on presentation of supporting documents.
Reimbursements for Products judged to be non-conforming or defective shall be made as soon as possible and at the latest within thirty (30) days following SANALYSLAB's finding of the lack of conformity or hidden defect. Refunds shall be made by crediting the Client's bank account or by bank cheque sent to the Client.
9.3. In what cases shall SANALYSLAB not be held liable?
SANALYSLAB shall not be held liable in the following cases:
- non-compliance with the legislation of the country in which the Products are delivered, which it is the Client's responsibility to check;
- in the event of misuse, use for professional purposes, negligence or lack of maintenance on the part of the Client, as well as in the event of normal wear and tear of the product, accident or force majeure.
SANALYSLAB's guarantee is, in any case, limited to the replacement or reimbursement of products that do not conform or are affected by a defect.
10. Intellectual Property
10.1. I like your site. Can I use your photographs, texts, comments or articles?
All trademarks, photographs, texts, comments, illustrations, animated or non-animated images, video sequences, sounds, as well as all computer applications that may be used on the website and more generally all elements reproduced or used on the website are protected by the laws in force with respect to intellectual property.
They are the full and complete property of SANALYSLAB or its partners. Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of SANALYSLAB, is strictly prohibited. The fact that SANALYSLAB does not initiate proceedings as soon as it becomes aware of these unauthorised uses does not imply acceptance of the said uses and waiver of proceedings. Any simple link or hypertext link is strictly forbidden without the express written agreement of SANALYSLAB.

12. Applicable law - Dispute settlement
12.1 How to proceed with a dispute?
In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, SANALYSLAB adheres to the Service of the E-commerce Mediator of the FEVAD (Federation of E-commerce and Distance Selling) whose contact details are as follows: 60 Rue La Boétie - 75008 Paris - http://www.mediateurfevad.fr.
12.2 When can I refer a dispute with SANALYSLAB to the mediator?

13. No partial validation
If one or more stipulations of these general conditions are held to be invalid or declared as such in application of a law, a regulation or following a definitive decision of a competent court, the other stipulations shall retain all their force and scope.
14. Force majeure
14.1 What are cases of force majeure and how are they dealt with?
Any circumstances beyond the control of the parties which prevent the performance of their obligations under normal conditions shall be considered as grounds for the release of the parties from their obligations and shall result in their suspension.
The party invoking the circumstances referred to above shall immediately notify the other party of their occurrence and of their disappearance.
All facts or circumstances that are irresistible, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts, shall be considered as force majeure. Expressly, the following are considered to be cases of force majeure or fortuitous events, in addition to those usually retained by the jurisprudence of the French courts and tribunals: blockage of means of transport or supplies, earthquakes, fires, storms, floods, lightning, stoppage of telecommunication networks or difficulties specific to telecommunication networks external to the Clients.
The parties shall meet to examine the impact of the event and agree on the conditions under which the performance of the contract shall be continued. If the force majeure event lasts for more than three (3) months, these general conditions may be terminated by the injured party.
15. Pre-contractual information - Acceptance and rights of the Client
15.1 What does acceptance of SANALYSLAB's GTC mean?
The Customer acknowledges having been informed, prior to placing his/her order, in a legible and comprehensible manner, of these General Conditions and of all the information and details referred to in Articles L. 111-1 to L. 111-8 of the Consumer Code, and in particular:
- the essential characteristics of the Product, taking into account the communication medium used and the Product concerned;the price of the Product and its ancillary costs;in the absence of immediate execution of the contract, the date or deadline by which SANALYSLAB undertakes to deliver the Product;
- information relating to the identity of SANALYSLAB, its postal, telephone and electronic contact details and its activities, insofar as they are not apparent from the context;
- information relating to legal guarantees and their implementation modalities;
- the functionalities of the digital content and, if applicable, its interoperability;
- the possibility of resorting to conventional mediation in the event of a dispute; information relating to the right of retraction.

The fact that a natural or legal person places an order on the Website implies full acceptance of these general terms and conditions of sale and the obligation to pay for the Products ordered.
